I was never in agreement when protesters started blocking roads during the Saturday protest. I still maintain that no matter how frustrating a situation may be, one must still maintain some decorum. That said the way the police have handled this situation is appalling.
In a criminal trial, there are usually two parties: the prosecution (the state) and the defence (the accused)
Lawyers representing the two sides have radically different responsibilities. The accused's attorney must make every effort to avoid a conviction.
The prosecution’s job is different. The goal is not to get a conviction by any means necessary. Instead, the prosecution must do all possible to achieve justice; ensure that, in the end, the accused is convicted only if guilty.
It follows that the prosecution must dismiss all charges if it becomes clear during the trial that the defendant did not commit the crime, regardless of whether there was evidence that could have resulted in a conviction.
Regarding the treatment of an accused person following their arrest, this responsibility of the prosecution is even more explicit. Because an accused person is innocent until proven guilty, if the prosecution must do justice, it must ensure the accused person has all the facilities to ground a defence. It must ensure the accused person is afforded a right to counsel and be treated with dignity (since he may be innocent after all ).
When the police and the attorney general's office collude to deny the accused access to food, healthcare, and legal counsel, the state has utterly failed in its duty to ensure due process through the criminal justice system.
This demonstrates that the state's goal is not justice but rather the punishment of those accused, stripping them of their human rights and dignity.
It takes just being a person of good conscience to know what is right and do same.
