Sophie Evans and James Lloyd successfully represented two Sussex police officers accused of gross misconduct before a Police Misconduct Panel.
After a four-day hearing, the panel made no adverse factual findings against James’ client and dismissed the case against that officer in its entirety. The panel made an isolated duties finding in respect of Sophie’s client and issued a warning.
The allegations related to the officers’ decision not to arrest a youth when tasked to do so. In the weeks that followed, the youth was murdered. It was further alleged that the officers had conspired to mislead colleagues, resulting in records of the arrest attempt that were deliberately misleading.
Following detailed submissions on the lawfulness of arrest discretion under the Bail Act, section 24 PACE and Code G, and reliance on the College of Policing’s APP on Risk, the panel accepted that the decision taken was a lawful, proportionate, welfare-led exercise of operational discretion. The case against the officers for breach of duty collapsed.
The defence emphasised that arrest is a power, not a duty, and that officers are legally required to assess necessity and proportionality under Code G before exercising that power. The panel agreed, adopting the reasoning of the APP, that policing decisions must be judged not by the quality of the decision itself, but by quality of decision-making at the time, uncontaminated by hindsight.
The outcome reinforced the principle that lawful discretion, properly exercised, should not amount to misconduct. It also provides reassurance for officers making rapid risk-based decisions in line with the National Decision Model and APP on Risk.

We are delighted to share with you the news we have formally adopted @RoyalAirForce Retired Police MWDs into the NFRSA family.
We were asked to consider the option some months ago, and with it being a huge step for us as a charity, we have approached it with care and consideration for both the RAF Police MWD sections (or bases), and the NFRSA.
When we first launched in 2022 we supported three services, but we knew as we grew, we would be able to widen that assistance.
The RAF Police MWD will be our eighth service - and we are incredibly proud to be welcoming these extraordinary Military Working Dogs, who have done so much to serve their country, to the family.
In respect for other charities who have historically helped retirees from the RAF Police and have them registered with their organisations, we will be looking after newly retired RAF police MWDs going forward, and with this official partnership and the blessing of the handlers and @RAF__Police we are hugely excited about the future, and look forward to working alongside the RAF family.

It was a huge privilege to be invited to attend the @UK_COPS Annual Police Service of Remembrance at the @Nat_Mem_Arb yesterday.
Attended by over 1,000 people, & Chief Constables from across the UK as well as senior officers, including @Glos_Police, and of course, the most important people, the families themselves.
Lady B stood with the Chief Constable of @PoliceScotland as she waved on the 34 riders from her force, who joined hundreds of amazing cyclists from constabularies across the country @PolUnityTourUK, as well as over 100 riders from @BlueknightsUKIC
It was an incredibly moving day as we heard from three brave family members who lost loved ones, their experiences were the nightmares none of us want to live through, yet they did.
The Chief Constable of @WestYorksPolice also spoke in his capacity as a Trustee.
UK Cops are an extraordinary charity. The day showed how much they do for survivors of the tragedy they’ve faced, and we have enormous respect for them all.
So, this post is not about the NFRSA, but it celebrates the work of one of our colleagues, and we salute them.
Look them up, they do so much.
