Matthew VanDyke; a US mercenary and founder of Sons of Liberty International; along with 6 Ukrainian nationals, entered India on tourist visas in December 2025, crossed into Mizoram WITHOUT a Protected Area Permit, smuggled a "large consignment of drones" through Indian territory into Myanmar, and trained ethnic armed groups linked to insurgents active in India's Northeast.

NIA registered the case under Section 18 UAPA; conspiracy. Then filed chargesheet under... visa overstay. Sections 21 & 23, Immigration Act. Compoundable offences. FRRO slapped a fine of Rs 5.5 lakh on each.

The decision to let American covert operative Matthew VanDyke and six Ukrainian drone specialists quietly leave India is more than an isolated legal reversal. It belongs to a long and uncomfortable tradition in which New Delhi invokes its tough criminal laws and then retreats when geopolitical pressure builds up.

VanDyke, a veteran of covert wars in the Middle East and Ukraine, was arrested in March alongside six military-trained Ukrainian partners. According to Indian court filings, the group belonged to a larger international network that smuggled drones into India before routing them onward to Myanmar. The National Investigation Agency initially invoked the Unlawful Activities (Prevention) Act, India’s premier anti-terrorism statute.

Then came the dramatic climbdown. After U.S. Secretary of State Marco Rubio personally raised VanDyke’s detention with New Delhi, the NIA dropped the UAPA charges. VanDyke and all six Ukrainians have now been released on bail and permitted to return home.

The episode recalls a familiar pattern. From the Bhopal gas disaster and the Purulia arms-drop affair to the Enrica Lexie Italian-marines case and Ottavio Quattrocchi’s escape in the Bofors scandal, India has repeatedly seen high-profile criminal proceedings against foreign nationals or entities diluted, abandoned or rendered inconsequential under diplomatic or strategic pressure.

Different cases, different Indian governments, but the same question endures: What makes India such a soft state that it so often fails to enforce accountability when powerful foreign interests are involved?

2014 नंतर या देशात न्यायालय, मंत्रिमंडळ, अधिकारी लोकांचे कार्यकारी मंडळ कशाप्रकारे काम करत आहे आपण बघतो..

न्यायपालिका व कार्यकारी मंडळाचे लोक घटनेत दिलेली सेक्युलरझम, समाजवाद, आदी तत्व कुठेही पाळताना दिसत नाही. उलट ते सनातनी विचाराने कार्य करतात, जणू ते भारत आणि सरकारचे नाही तर भाजप RSS चे काम करतात.. पगार मात्र भारत देशाची घेतात.

म्हणून ज्ञानेश कुमार यांच्या नेतृत्वाखालील निवडणूक आयोगावर आता प्रश्न विचारणे भाग आहे.

The Indian Express च्या 25 सप्टेंबर 2026 रोजीच्या तपासणी अहवालानुसार, निवडणूक आयुक्त सुखबीर सिंह संधू आणि विवेक जोशी यांनी मागील 10 महिन्यांत किमान 14 वेळा लेखी आक्षेप नोंदवले. हे आक्षेप मतदारांची नावे जोडणे, वगळणे, पुन्हा समाविष्ट करणे, Form-6 मधील बदल आणि मतदारांच्या डेटाच्या नियंत्रणाशी संबंधित होते.

आणखी गंभीर बाब म्हणजे, अहवालानुसार दोन्ही आयुक्तांनी काही निर्णयांबाबत “unauthorised” आणि “illegal” असा आक्षेप नोंदवला होता. मतदारयादीच्या IT व्यवस्थेचे केंद्रीकरण करण्याबाबतही त्यांनी प्रश्न उपस्थित केले.

SIR प्रक्रियेत 30 राज्ये आणि केंद्रशासित प्रदेशांच्या draft electoral rolls मधून 13 कोटींपेक्षा जास्त नावे वगळली गेल्याचे Indian Express ने नोंदवले आहे.

ही नावे अंतिमतः कायमची वगळली गेली आहेत असा अर्थ मात्र या आकड्याचा होत नाही , ही draft-roll प्रक्रिया आहे.

आता दुसरी बाजूही स्पष्ट असली पाहिजे.

निवडणूक आयोगाने या अहवालाला उत्तर देताना म्हटले आहे की अंतर्गत मतभेद आणि written observations हे संस्थात्मक decision-making चा भाग आहेत आणि गेल्या वर्षातील निर्णय पूर्ण आयोगाच्या unanimous decisions ने झाले, असा आयोगाचा दावा आहे.

म्हणूनच प्रश्न आणखी सोपा आहे!!
14 लेखी आक्षेप नेमके कशासाठी होते?
त्या आक्षेपांवर काय निर्णय झाला?
Form-6 मध्ये बदल कोणाच्या अधिकाराने झाला? मतदारांचा डेटा कुठे आणि कोणाच्या नियंत्रणाखाली आहे?

आणि 13 कोटी नावांच्या draft deletion ची संपूर्ण प्रक्रिया जनतेसमोर पारदर्शकपणे का ठेवली जाऊ नये?

निवडणूक आयोगावर विश्वास ठेवायचा असेल तर विश्वास मागून मिळत नाही तो पारदर्शक प्रक्रियेतून निर्माण होतो. आयोगाने इमानदारीने निवडणूक प्रक्रिया पार करणे त्यांचे कर्तव्य आहे. त्यासाठी ते पगार घेतात.. फुकट करत नाही काम. लोकांच्या कष्टाचा पैसा आहे..

मतदारयादी तुमची-माझी आहे.
मतदानाचा अधिकार तुमचा-माझा आहे.
म्हणून प्रश्न विचारण्याचा अधिकारही आपलाच आहे.

फॅसिझम व नाझी सारख्या सिस्टीम मध्ये प्रश्न विचारणे गुन्हा असतो लोकशाहीत नाही.
लोकशाहीत प्रश्न टाळणे म्हणजे हुकूमशाहीकडे निघाल्याची घोषणा.
