Virginia passed a new gun ban โ and now some of the very prosecutors expected to enforce it are saying no.
The law makes it a misdemeanor to buy, sell, transfer, import, or manufacture certain โassault firearms,โ punishable by up to a year in jail and a $2,500 fine.
That means a rifle that was legal on June 30th became a crime on July 1st because politicians moved a line on paper.
But at least five Virginia prosecutors have already said they will not enforce the ban, arguing that it violates the Second Amendment.
And hereโs the poetic part: Virginia Democrats helped protect prosecutorial discretion years ago, meaning the governor and attorney general can complain all they want โ but they canโt force those prosecutors to bring charges.
They built the off-switch. Now itโs being used on their own gun ban.
This is a win, but itโs not the end. The law is still on the books statewide, and the real fight is in court.
With more than 20 million AR-15s in America and the rifle clearly in common use, this is exactly the kind of case the Supreme Court needs to stop ducking.
