6. Kinda but barely accurate, only right insofar as securities are being exchanged on the exchanges. If they’re not securities, SEC has no jurisdiction
@mcuban@matt_levine 3. There isn’t a framework under securities law supporting the notion that a disconnect between operational performance and the value of a tied-in publicly exchangeable asset leans against the asset being a security. Interesting idea, but hard to imagine how that would work.
@kickswish re Berhalter 12/11 statements (which were made at a private 12/6 event but accidentally published 12/11), worth noting that he had spoken at the event under the assumption that his comments would be “explicitly off the record,” as confirmed by multiple US Soccer spokespersons.
