تبدیل مدارس به اماکن نظامی و سیاسی، مصداق استفاده از سپر انسانی و جنایت جنگی است

تصاویر منتشر‌شده از ایران نشان می‌دهد همزمان با هدف قرار گرفتن مداوم اماکن نظامی، انتظامی، امنیتی و سیاسی جمهوری اسلامی توسط آمریکا و اسرائیل، نیروهای نظامی و انتظامی و مقامات سیاسی به مدارس منتقل شده و آن‌ها را تبدیل به اماکن نظامی و سیاسی کرده‌اند.

استقرار نیروهای نظامی، انتظامی یا امنیتی در مدارس، عملا جان غیرنظامیان را در معرض خطر مستقیم قرار می‌دهد. مدارس در ایران عمدتا در مناطق متراکم مسکونی قرار دارند و تبدیل آن‌ها به محل استقرار نظامی، مرز میان هدف نظامی و غیرنظامی را مخدوش می‌کند. بر اساس ماده ۴۸ و ۵۲ پروتکل الحاقی اول ۱۹۷۷ به کنوانسیون‌های ژنو، اصل تفکیک میان اهداف نظامی و غیرنظامی الزام‌آور است و اماکن آموزشی در زمره اهداف غیرنظامی محسوب می‌شوند.

علاوه بر این، ماده ۵۱ (۷) همان پروتکل، استفاده از حضور غیرنظامیان برای مصون‌سازی اهداف نظامی را ممنوع کرده و ماده ۸ (۲) (ب) (xxiii) اساسنامه دیوان کیفری بین‌المللی، استفاده از سپر انسانی را به‌عنوان جنایت جنگی شناسایی می‌کند. استقرار عامدانه نیروهای مسلح در کنار کودکان و مناطق مسکونی، مصداق به خطر انداختن آگاهانه غیرنظامیان است. هیچ توجیه امنیتی نمی‌تواند مسئولیت جنایت احتمالی ناشی از چنین تصمیمی را رفع کند.

در چنین شرایطی، هرگونه تصمیم برای استقرار نیروهای مسلح یا مقامات سیاسی در محیط‌های آموزشی، مسئولیت حقوقی مستقیم برای تصمیم‌گیرندگان ایجاد می‌کند. حمایت از غیرنظامیان، به‌ویژه کودکان، تعهدی مطلق در حقوق بین‌الملل بشردوستانه است و نقض آن می‌تواند پیگرد کیفری بین‌المللی در پی داشته باشد. تبدیل مدرسه به سنگر، نه اقدام دفاعی، بلکه اقدامی است که آگاهانه جان غیرنظامیان را در معرض خطر قرار می‌دهد.
