They actually do kill Shredder in #1, but Eastman and Laird couldn’t help themselves, and they eventually brought him back.

In the original comic, the Ninja Turtles were specifically trained to kill Shredder to fulfill Splinter’s vendetta against him. Not even in self defense, or to save the city, but out of revenge.... This has since been retconned.
