To Every U.S. Servicemember:

You should not obey manifestly unlawful orders. This open letter is intended to warn you that President Trump’s recently declared policy of destroying a bridge or power plant in response to every Iranian attack on a ship is manifestly unlawful. You therefore cannot later claim that you were unaware of the legal implications of such a policy or that you had no reason to question an order issued pursuant to it.

Your president has stated publicly:

“From this point forward, any time the Islamic Republic of Iran shoots at a ship in the Strait of Hormuz, whether it be by Missile, Rocket, Drone, or any other device or weapon, the United States will bomb and destroy ONE BRIDGE OR POWER PLANT, including those located next to, or in, the Capital City of Tehran.”

This is not a lawful targeting doctrine. It is an announced policy of automatic retaliation The target is not selected based on its current military use, contribution to military action, or definite military advantage in the circumstances ruling at the time. It is selected as punishment.

Under international humanitarian law, this is unlawful.

The principle of distinction is absolute. Attacks may be directed only against lawful military objectives. Civilian objects that are not being used for military purposes making an effective contribution to military action are protected and may not be made the object of attack.

A policy requiring the destruction of “ONE BRIDGE OR POWER PLANT” for each Iranian attack on a ship is not targeting. It is reprisal and collective punishment. Both are prohibited. Reprisals against civilians and civilian objects are forbidden under customary international law and Additional Protocol I to the Geneva Conventions. Collective punishment of civilians for acts they did not commit is prohibited by the Fourth Geneva Convention and customary law.

Military necessity does not authorize punishment. Proportionality does not authorize automatic destruction of civilian infrastructure in response to an attack elsewhere. Precautions in attack cannot be satisfied when the policy itself selects targets for retaliation rather than for their specific military function at the moment of attack.

Intentionally directing attacks against civilian objects, or launching attacks expected to cause excessive incidental civilian harm, constitutes a war crime.

U.S. domestic law reaches the same conclusion.

Under 18 U.S.C. § 2441, the War Crimes Act, any person who commits a war crime is subject to criminal penalties up to life imprisonment or death if death results. The statute applies to U.S. servicemembers and nationals. Recent amendments confirm there is no statute of limitations for the core war crimes covered by the Act. Time does not erase liability.

The Uniform Code of Military Justice and Department of Defense Law of War Manual are clear: you are required to obey "lawful" orders. You have a duty to refuse manifestly unlawful orders. Superior orders do not excuse conduct when the order is patently illegal or you knew or should have known it was unlawful. The President’s rank, the Secretary of Defense’s order, or a general’s command does not make an unlawful attack lawful. Responsibility is personal.

This statement by your Commander-in-Chief does not stand in isolation. It fits a broader pattern. You are not required to participate in this.

If you are ordered to plan, authorize, transmit, facilitate, or carry out an attack on a bridge, power plant, school, or other civilian object selected for retaliation, that order is manifestly unlawful.

You have a legal and moral duty to refuse it. Raise the objection through the chain of command. Seek legal advice from a judge advocate. Document the order in writing. Report suspected violations through lawful military channels and, where appropriate, to oversight bodies.

If continued service would require you to participate in war crimes, resign.

Do not commit war crimes for any president.
