The Treasury and CBK have only published it as a draft for public participation, so this is exactly when Kenyans should read the fine print.

The National Payment System Bill, 2026 proposes major changes to how money and financial data move in Kenya. It would introduce open finance, allowing customers to authorise banks, M-Pesa and other payment providers to share their financial data with licensed third parties. It also pushes interoperability, making it easier for banks, mobile-money networks, wallets and fintechs to transfer money across platforms.

There are clear benefits: more competition, easier movement of money, better fintech products and potentially better access to credit because customers can choose to use their financial history with another provider.

But the bigger question is DATA.

Once Kenya creates infrastructure through which detailed financial information can be securely shared across institutions, we must establish very strong boundaries around who can access it, for what purpose, for how long and under what legal authority.

The current draft does not automatically give KRA access to everyone's bank or M-Pesa transactions through open finance. Customer consent is central to the proposed open-finance framework. But much of the implementation detail will ultimately depend on regulations.

That is where public participation matters.

Today it is consent-based open finance. Kenyans should ensure the law is written strongly enough that tomorrow it cannot quietly become an infrastructure for financial surveillance without proper legal safeguards.

Public comments are open until 9 October 2026.
