MEX & CAN will wage jujitsu against Trump. Trump thinks USA’s huge GDP means he will win a #tradewar. Most of the wealth is generated from Blue areas where Trump is politically weak. The retaliatory measures will target poorer Red areas where Trump derives political strength.
Every corporate communication person, and every in house counsel are face palming. Trump threw his soldiers under the bus, and gave away leverage in the impending mass tort lawsuit.
I seriously doubt anyone thought about government IP rights when issuing the order. I also hope inventors/researchers/contractors out there consult a lawyer before doing anything hasty. But there is an open legal question here. 8/END
Yesterday the Trump Administration halted spending on grants and other loans. My attention immediately turned to researchers and their rights in IP. Suppose a “flash of genius” happened during the pause? Would more IP rights accrue vis-a-vis the government? 1/8
If someone has a colorable argument that they acted in anticipatory breach, then maybe there was Constructive Termination for Cause. And since the government didn’t pay for the idea on Jan 28-29, maybe the IP is theirs. 7/8
