On September 24, 2025, the Supreme Court of Canada granted a STAY ORDER in our case at Universal Ostrich Farm, which clearly states:

“The respondent shall maintain custody of the birds that are subject to the Notice to Dispose.”

What “Maintain Custody” Means

Under Canadian law, to maintain custody means to protect, care for, and preserve the wellbeing of what is under one’s charge.
It does not mean to destroy, starve, stress, or alter the animals’ natural environment. Custody implies a legal duty of care and responsibility, not control for harm or disposal.
Our ostriches have now been in CFIA custody for 35 days, and their health is rapidly deteriorating.
They are losing weight, have no proper bedding, and are drinking from contaminated puddles. They are being fed insufficient, poor-quality hay, forcing them to eat the stems out of hunger risking impaction and internal harm. Injured birds have been forced out of recovery pens and pushed into large groups, causing re-injury and suffering.
We WILL NOT allow another tragedy like Spirit to happen again.

The World Is Watching
This is animal cruelty and a breach of the Supreme Court’s stay order. The CFIA was ordered to maintain custody, not to prepare to kill, terrorize, or disrupt the flock’s welfare.
