A simple reading of the Copyright and Neighbouring Rights Act shows the following:
1. Under section 9 of the Act, copyright vests in the owner of an artistic or musical work by operation of law.
2. Under section 17 of the same Act, the owner has the right to authorize the performance of said musical work in Zimbabwe.

There is a peculiar sickness consuming sections of Zimbabwe’s opposition and its media commentariat: Chamisa Derangement Syndrome.
For some, politics no longer begins with, “How do we defeat ZANU-PF?” It begins with, “How do we prove Chamisa wrong today?”
Hopewell Chin’ono has become perhaps the loudest example. The recurring thesis is Chamisa failed, Chamisa is the problem, Chamisa must be discarded. But there is a fundamental political problem with this obsession: you cannot build an alternative by endlessly attacking the alternative people already prefer.
Worse, it insults the electorate.
Millions of Zimbabweans who continue to identify with Nelson Chamisa are not necessarily hypnotised, stupid or incapable of recognising his shortcomings. They simply have not been shown something they consider better.
That is the burden of politics.
You don’t win a girl by camping outside her house shouting that her boyfriend is useless. You show her why you are the better man. Obsessively attacking your rival merely advertises your insecurity.
Politics works much the same way.
If Biti, Sikhala, Welshman Ncube, Hopewell or anybody else believes Zimbabwe needs something beyond Chamisa, then build it. Present the organisation. Present the programme. Mobilise the people. Fill the stadiums. Win the constituencies. Demonstrate superior political capital.
The democratic answer to Chamisa is not explaining why people are stupid for supporting him. It is becoming more persuasive than Chamisa.
Criticise him. Challenge him. Expose his mistakes. Nobody should be beyond scrutiny.
But when your entire political identity becomes opposition to an opposition politician while ZANU-PF still controls the state, you have lost the plot.
The public will abandon Chamisa when something more compelling emerges.
Until then, constantly shouting “Chamisa!” isn’t strategy.
It is political impotence masquerading as journalism!
Please educate Hopuwero. It is not the size of the document or the number of pages that makes a constitution. The United Kingdom actually has no written text at all, but is one of the leading democracies in the world.
Also, kindly explain to him that the CCC constitution as it then was intended, was a working document as the party had not yet held its inaugural congress due to the pressing time between its formation and the general elections. Therefore, its authors designed it as an evolving document that could guide the party before its congress and retain the flexibility to incorporate the views of congress later on. Obviously, the congress never then took place when Tshabangu, working with ZANU-PF hijacked the party.
Lastly, and sadly for many african case studies; having a well written constitution is not enough, you need the political will and the political culture to actualize, comply and fully implement the constitution, and not use purported majorities to alter or adjust the constitution to undermine democracy or entranch yourself beyond what the constitution intended.
Analysts without solutions, fighting anyone who attempts to do something, Zim’s social order. In the words of Benjamin Burombo “Each time I want to fight for African rights l use only one hand-because the other hand is busy trying to keep away Africans who are fighting me."
The problem is you fear asking those in power to account. Your call on the opposition is not about accountability, what should a person who lost the election account to you about? Is your poverty caused by the opposition? Attack and accountability are two different things.
1. Let's make a few things clear.
Firstly, there's no scenario where a person moves from the Opposition to ZanuPF for any genuine reason(s) or the benefit of the collective.
Anyone who does so, betrays their own convictions and principles, if ever they had any, to begin with.
The genuine opposition movement will only make progress if it disentangles itself from Hopewell.
He lacks principles, is petty, narcissistic, gossipy, inconsistent, malicious & intellectually bankrupt.
He was embedded in the coup regime & doing a PR service for it, while publicly defending his friend Chigumba even while she helped preside over a stolen election.
He has never sought to hold her accountable for her role in the manner a multi award winning journalist would be expected to.
Whether it was ballot papers, V23A & V11 forms, election observer reports & implausible figures, he always pivoted towards blaming the opposition.
Even her alleged role in the Reinform CC saga was barely, if at all scrutinised.
Instead, he relentlessly focuses on bashing victims of the regime's oppressive rule & plants unrealistic expectations into the minds of the frustrated masses.
There is neither clarity nor a timeline showing when, how & why he stopped supporting the coup regime that he so fervently embraced.
It's neither plausible nor defensible for a multi award winning Harvard & Oxford educated & principled journalist to simply support a coup regime for the reasons that he gave, particularly with the extrensive anti-human rights record ED already possessed at that time & simply exit it almost by stealth, in the manner that he claims to have done.
The more likely reality is that, he supported the coup regime for reasons that remain undisclosed, and for those reasons, his claim that he ceased supporting it are untested & thus objectively unconvincing as his motives remain beyond scrutiny.
Following from this, his claims to want to hold opposition leaders accountable ring hollow on account of a lack of integrity & credibility.
Genuine & principled journalists rarely choose to become coup apologists, carrying out PR services for brutal regimes.
There is a jarring inconsistency & incompability there. You report news & end there.
You don't cross the journalistic line & compromise your ethics to become partisan & a key player.
If you do, it becomes reasonable to challenge what caused you to sway as well as whether or not a character that easily abdicates such hallowed principles was ever truly committed to them in the first place & can claims to have returned to them pass the credibility test?
Can such a man pass that same test when he relentlessly bashes those he previously stood in opposition to while ingratiating himself with a regime armed to the teeth?
Is he genuinely holding them to account or he's still in secret service to the same regime & carrying out a sinister assignment surreptitiously?
Those are the hard questions we should ask ourselves in light of the chequered & blurry history highlighted above!
I still do not understand why @daddyhope thinks that @nelsonchamisa should report or account to him. As who? Why should @nelsonchamisa present party documents to @daddyhope and on Twitter? Most of those documents are security sensetive. Even if there were not, who is Hopewell that he should demand those documents to be presented to him. The people know their leaders and they have full confidence. By the way, he (Hopuwero) still hasn't produced any evidence that I am a CIO despite promising to do so three years ago. Our cadres and change champions must not be distracted by Hopewell's attention seeking antics but remain united and focused on the task at hand-to dislodge Mnangagwa and restore constitutionalism in Zimbabwe.
