So he approached the District Consumer Commission, Baramulla.

The company was served notice.

They did not appear.
They did not file any reply.

The case went ex parte.

The Commission looked at the facts:

Money was taken.
Service was not provided.

That was enough.

The court held this as:

Deficiency in service.
Unfair trade practice.

And laid down an important legal principle:

A “non-refundable” clause cannot override the law.
If no service is delivered, retaining fees is illegal.

Order:

Refund ₹35,000
Pay ₹50,000 as compensation for academic loss
₹10,000 as litigation cost

Now think about this.

Almost every coaching institute, edtech platform, and skill program in India uses the same clause:

“Fees are non-refundable.”

But the law is clear:

You cannot take money
and then hide behind terms
when you fail to deliver the service.

No clause can protect unfair conduct.
