In this episode of the Court Helicopter Explainer, Lawyer Danstan Omari clarifies a major change in Kenya’s marriage and divorce law. Previously, the Marriage Act (2014) required couples in a civil marriage to wait at least three years before filing for divorce even in cases of violence, abuse, or mental and emotional harm.

However, the Court of Appeal declared this 3-year waiting period unconstitutional, and the government’s grace period to amend the law expired in June 2025.
