@Number10cat Only loud miaowing? What about the claws in the face as you pull back the duvet? What about the whiskers up the nose when that doesn't work??
The decision in T 56/21 has now appeared. The Board has changed their mind and decided not to refer questions to the Enlarged Board after all. However, the Board's reasoning is contrary to current EPO practice, which requires that the description is amended in line with allowable claims. Key points of the reasons:
"The wording of Article 84 EPC as well as its context leave no room for requiring, in examination, that the description be adapted to allowable claims to match their subject-matter" (paragraph 100).
"The Board is also not persuaded by the reasons for the practice requiring the description to be adapted to allowable claims. A more uniform determination and better predictability of the extent of protection of a granted European patent in infringement proceedings can only be achieved if granted claims are clear in themselves. Adapting the content of the description to match the subject-matter of allowable claims reduces the reservoir of technical information that could be used in national courts in the Contracting States to determine the protection conferred by the granted patent" (paragraph 102).
It looks like the battle about whether description amendments are required will continue.

On the 3rd Sept 1953, the #EuropeanConventionOnHumanRights came into force. Today, let's be proud of the commitment the UK has shown to peace & human rights.
▶ Written by British lawyer David Maxwell-Fyfe
▶ Supported by Churchill
▶ Helped rebuild peace after WWII
A song for @elonmusk about his platform and his pathetic recent forays into UK politics. (And anyone who liked The Kids from Fame - the parody song is Desdemona)
If we get booted from Twitter for it, do follow us somewhere here: https://t.co/UNysTPCXtw.
Backstage at a concert in 2015 at my children’s school -Trinity in Nottingham. Now plans to drastically cut music and creative arts from this wonderful state school. Protest strike on Wednesday and Thursday this week. Where will the future of music come from?
Very excited to be singing with our new American Friends* @Bristol_Beacon tomorrow 🇺🇸🎼🎵Come along for a spectacular evening of music. (*we haven’t actually met yet, but I just know☺️)
Me: I've decided I need to stop listening to mid-20th century English choral music for the sake of my mental health
Therapist: Lo, the full, final sacrifice
@PhysInHistory Don't read it. I have read it, seen the film/TV adaptations, even seen the stage show version.
No, listen to the original radio version. Douglas Adams wrote it for the radio. It is far, far better in the original, and can be listened to again and again.
Time to launch my manifesto:
1. Creation of a new meal between breakfast and brunch
2. If it's not sunny on a bank holiday everyone gets a rollover until it is
3. Legally declare that nostalgia isn't as good as it used to be
4. Rename the Isle of Dogs (it's actually a peninsula)
5. Rejoin the EU but let everyone who voted to leave pretend that we still have
6. Creation of a new meal between brunch and lunch
