The line that stole the show involved having “an IQ above a toaster”…before taking a direct shot at Senator Schumer.

Last week, Derek Smith and I went to the Midland County Courthouse to film and conduct a First Amendment audit.
The moment Officer Davis saw us with our cameras, he greeted us professionally. He did not try to intimidate us, interfere with our filming, or make the situation difficult. He was respectful, helpful, and treated us exactly how citizens should be treated inside a public building.
After seeing troubling encounters between citizens and public officials elsewhere in Midland, it is important that we also recognize officers who get it right.
Officer Davis kept the peace without creating a confrontation. He represented the Midland County Courthouse with professionalism, kindness, and respect.
Good officers deserve public recognition too.

THE CITY OF MIDLAND’S STATEMENT RAISES MORE QUESTIONS THAN IT ANSWERS.
The City of Midland has finally released a statement.
After reading it, one thing stands out.
They admit this citizen was never accused of committing a crime.
Instead, they repeatedly describe him as making employees feel “threatened,” “uncomfortable,” and “disruptive.”
Those are subjective descriptions.
The public has now watched the video.
Many people are asking a simple question:
Since when is making a government employee uncomfortable grounds for being pepper sprayed inside City Hall?
The City’s statement says employees felt threatened.
If that’s true, what exactly was the threat?
What crime was committed?
Why wasn’t he arrested?
Why wasn’t he charged?
If officers believed he committed an offense serious enough to justify force, where are the criminal charges?
Those are fair questions.
The statement also says city staff had been dealing with him for days and even escorted him to the Midland Police Department earlier that morning.
Yet nowhere does the City explain why the situation escalated to pepper spray instead of simply allowing the man to finish requesting public records or peacefully leave on his own.
The public deserves specifics, not broad descriptions like “aggressive” and “disruptive.”
Fortunately, this wasn’t hidden behind closed doors.
There’s video.
People can watch it for themselves and decide whether the City’s statement matches what actually happened.

Who actually wrote this statement?
Was it City Manager Tommy Gonzalez?
Communications Director Stewart Doreen?
The City Attorney?
Or someone else?
The people of Midland deserve to know who is speaking on behalf of their government, especially when defending the use of force against a citizen inside City Hall.
Government works for the people.
When force is used against a taxpayer in a public building, the burden shouldn’t be on the public to prove something went wrong.
The burden is on government to explain why it happened.
And based on the questions pouring in today…

The video shows what happened next.
A taxpaying citizen inside City Hall was pepper sprayed by a Midland police officer while trying to obtain public records. Despite everything that happened, no criminal charges were filed.
The City’s statement says he was aggressive and disruptive. The public now has the opportunity to compare that statement with the video and decide whether the response matched the situation.
Was this a reasonable use of force?
Or did the City and Midland Police go too far?

A Midland citizen went to City Hall requesting paperwork.
He sat inside the public building for an extended period speaking with Strategic Communications Director Stewart Doreen. The footage appears to show that he never raised his voice, never became violent, and was not told what crime he had committed.
Then a Midland Police Department officer arrived.
She issued commands, placed her hands on him, and ultimately pepper-sprayed him inside City Hall.
He was taken outside in handcuffs, transported to the hospital, and reportedly handcuffed to a hospital bed. He has a heart condition and had expressed concern about being forced outside into the extreme heat.
After officials reviewed the footage and saw that he had not been acting belligerently, he was released with no charges.
No identified crime. No charges. Yet a citizen requesting paperwork from his government ended up pepper-sprayed, handcuffed, and hospitalized.
What lawful justification was there for this use of force?
