Let me rephrase cause Victor Ogbuja was never tried.

Despite the video evidence Ochanya made before she died, and despite the medical reports showing tears in her vagina and bladder, among other injuries, the court still acquitted Mr. Ogbuja.

This is not necessarily because the judiciary is corrupt. It is because the law sets out a strict checklist of elements that must be proven to convict a person of an offence.

So, for instance, if there was no DNA sample of the accused swabbed from her privates, no witness statement, or other corroborating evidence, then even if it’s clear that a räpe occurred, it may still be impossible to legally tie the act to the accused.

But that’s not even the main point I want to make.
What I want to address is allegations and how we treat them.
Time and again, when men are accused of räpe and the courts do not convict them, society turns around to brand the women as false räpe accusers.
But as we see in cases like this, the accusation may not be false, it just could not be proven.

So, whenever there’s a rąpe case and the accused is discharged, please don’t rush to bully or shame the victim.
Crimes, especially sexual crimes, are hard to prove. The burden of proof lies on the prosecution. And the truth is, no one who has just been räped immediately knows what to do.
They may not think to rush to a hospital for a DNA swab, they may have no eyewitness and even something as simple as taking a bath can destroy crucial evidence.

Heck, even if a judge witnessed the act himself, he is bound to decide strictly on the evidence presented before him.
So, remember, not every allegation that fails in court is false.
