We're concerned that the administration cannot simply rescind it with the stroke of a pen; it would likely need to go through another Administrative Procedures Act rulemaking process with a mandatory public comment period, etc. The regs are still judicially vacated.

If a complainant reporting an incident right after it happened in itself makes her more credible, then the reverse must also be true: that reporting it much later must - in itself - reduce her credibility.
"All sex is rape" is not a mainstream feminist view per se, but it's too close. Fake and broad rape definitions, hostility to due process (so that whatever your definition of rape is, it doesn't matter), and a demand that false accusations are ignored/unpunished are mainstream.
An actual, very mainstream, feminist claim is that all heterosexual sex is rape.
This is complete bullshit, of course. Consent simply means "Saying yes" or "not saying no." The only exceptions are force and threat of force. If 'game' - say, lying about body count or sexual intentions in marriage- voided consent, women would be """""rapists""""" at a slightly higher rate than men.

While much effort is spent on consent education to prevent future sexual misconduct, many would-be accusers also need consent education to stop them from accusing people based on incorrect definitions of rape. But that cannot happen so long as reporting is prioritized above all.

In contrast to VaTech ruling (strong holding for acc'd student), student in @ColoradoStateU case drew a Biden-nominated judge; granted MTD on both due process & TIX counts. Due process section relied almost entirely on Goss (HS suspension case) & CA10 case involving 9th grader.

True also in Title IX grievance procedures. Even when you are right, be respectful/professional in your language to the other party and the process, which will go further in the eyes of the decision-maker. And don't overplay your hand.

Title IX grievance procedures consistently demonstrate that being more sexually conservative - in the sense of only engaging in sexual behavior around someone you know well - is best. And that goes for both complainants and respondents, both men and women.
