An African couple convicted in Ireland's first female genital mutilation (FGM) case has had their bid to declare the conviction a miscarriage of justice advance, potentially paving the way for significant taxpayer-funded compensation.
The parents, originally from a French-speaking African country, were found guilty in 2019 of subjecting their infant daughter to FGM.
The case came to light when they brought the 21-month-old girl to a Dublin hospital with uncontrollable genital bleeding. Medical experts at the time identified the injuries as consistent with the brutal practice.
They served two years in prison before the Court of Appeal quashed the convictions in 2021, citing translation errors during the trial that disadvantaged the non-English speakers.
A retrial in 2023 ended in a hung jury, and prosecutors eventually dropped the charges in 2024.
Now, relying on new expert reports—including one from a Swedish professor that "broadly" supported their defense—the couple is pushing for official recognition as victims of a miscarriage of justice. A court recently reserved judgment on this application.

FGM is a horrific, illegal act of child abuse with lifelong consequences for victims. Declaring this a full miscarriage risks sending the message that cultural defenses or technicalities can shield parents from responsibility when evidence of harm is present.
Irish authorities pursued this as a landmark case for good reason protecting vulnerable girls from barbaric traditions imported from abroad. Any compensation payout would add insult to injury for those committed to zero tolerance on FGM.
The priority should remain safeguarding children, not rehabilitating the reputations of parents whose actions triggered such grave suspicions in the first place.
