If you employ ANY SOFTWARE DEVS, you are WELL AND TRULY SCREWED if H.R. 7024 doesn't pass the Senate. It passed the House by a vote of 357 to 70 with OVERWHELMING bipartisan support. The fact that @MikeCrapo, @SenThomTillis, and others are blocking it now to try to get something better for themselves in 2025 is sickening.

And no, it's not just about R&D Tax Credits. Even if you don't claim those YOU ARE IMPACTED. This law is about having to capitalize nearly your ENTIRE PAYROLL EXPENSE for ANY Software development related activity and amortize it over 5-years for domestic labor. 15-years for foreign labor!

So guess what, if you lost money, broke even, or heck were lucky and made a small profit in 2023, but you had $1M in software development related salaries...you're out of business and bankrupt. It's as simple as that. Unless you have ~$900k of profit sitting around to just throw away on bad tax policy this year, you will not survive without incurring a crazy amount of personal debt or severely dipping into your cash reserves like we did at my company last year.

Think $1M in software development related salaries and expenses is a lot? It's not. In the US, I can all but guarantee that to be a team of 10-12 people or less. But also it doesn't matter. $1M is arbitrary. If you're a very small software dev shop and broke even but paid $50k in dev salaries, you have to pay tax on 90% of that $50k of salaries, even though you already paid the salary to an employee and made no money. Sound crazy? That's because it is.

I cannot fathom how this is even a debate?!? This isn't some sort of TAX BREAK for the wealthy, that's actually what got us here in the first place. No, it's about fixing what the government already broke with the Trump era Tax Cuts and Jobs Act in 2017. When that policy went into law in 2022, it DESTROYED thousands of businesses. Mine barely survived.

If you don't think your business is impacted, you're probably WRONG. I've spoken to many agency owners who have said to me personally "We looked into the R&D tax credits but didn't think we qualified, so we never took advantage of that, luckily". But that's the thing, it doesn't matter. You're still beholden to the current definition of Research & Experimental (R&E) expenditures which is entirely different than claiming R&D Tax Credits. The definition of R&E expenditures currently states...

Without the passage of HR 7024, a TON of American small business software team will not survive the 5-year amortization window, and the huge wave of layoffs in tech will continue.
