ONE OF the greatest project risks today rests on clients. There are several stalled and disputed projects in this sector resulting primarily from a client’s failure to meet their obligation. Yet the sector continues to demand that only contractors provide guarantees for performance.

In most construction contracts there is no requirement that an employer/client provides a performance bond. Even where it is provided for in standard contracts (like JBC attached) consultants always ensure such a clause is deleted.

Why does the industry continue to burden only contractors when employers/clients have become one of the greatest project performance risk? Look at public sector projects for instance, employer’s adherence to payment obligation is a major problem. We need to fix this.
