Update

Since the court appearance of Dr. Mahrang Baloch, Beebow, Gulzadi, Sabghatullah Shah Jee, and Beebarg Zehri on Tuesday last week, these individuals have been shifted to separate police stations in clear contravention of due process.

Despite the fact that two different lower courts have issued explicit orders directing the police to allow family and legal counsel access for the purpose of signing legal documents and preparation of defense, we have continuously been denied this fundamental right or made to wait for hours to get legal documents signed.

The behavior of the police station administration, particularly those responsible for the custody of these female detainees, is not only uncooperative and rude but also in direct violation of the Constitution of Pakistan, specifically Articles 10 and 10-A, which guarantee the right to fair trial and legal representation.

The continued denial of access to Sabghatullah Shah Jee and Beebarg Zehri, who are held in a Cantonment police station, is especially alarming, as neither legal counsel nor family members have been informed of their condition or provided access. This constitutes a serious breach of judicial orders and amounts to unlawful detention.

The women police station, where Dr. Mahrang Baloch, Beebow, and Gulzadi are held, is under the de facto control of the Counter-Terrorism Department (CTD) and intelligence agencies, rather than the civilian police.

We fear that detainees are being subjected to psychological harassment, intimidation, and denial of prisoner rights, including access to counsel, family, and medical care, which are guaranteed under Rule 974 of the Police Rules, 1934, and international human rights law to which Pakistan is a party.

In addition to these violations, I am myself being continuously surveilled and harassed by intelligence operatives, who appeared outside my residence past midnight, clearly aiming to intimidate and suppress any form of lawful advocacy.
These actions represent gross violations of Pakistan’s domestic legal obligations, including:
•Article 9 (security of person)
•Article 10 (right to due process)
•Article 14 (dignity of man)
•Article 25 (equality before law)

Moreover, Pakistan’s international legal commitments, including its obligations under:
•The International Covenant on Civil and Political Rights (ICCPR)
•The Convention Against Torture (CAT)
•The GSP+ trade framework of the European Union, which requires adherence to core human rights conventions are being systematically undermined.

Given that @GovtofPakistan is a beneficiary of the European Union's GSP+ status, which is contingent upon upholding human rights, rule of law, and democratic principles, it is now vital for the @EUPakistan and relevant international bodies including @OHCHRAsia to hold the Government of Pakistan accountable for these violations and ensure compliance with both local court rulings and international obligations.

We urge immediate intervention from the judiciary, civil society, bar councils, and international human rights mechanisms to restore the rule of law and protect the fundamental rights of these detained individuals.

ڈاکٹر ماہ رنگ، بیبو، گلزادی، بیبرگ بلوچ، صبغت اللہ اور ماما غفار کو گزشتہ روز دس روزہ ریمانڈ پر تھانہ منتقل کیا گیا، تاہم اس کے بعد سے 36 گھنٹے سے زائد کا وقت گزر چکا ہے اور انہیں نہ لواحقین سے ملاقات کی اجازت دی جا رہی ہے اور نہ ہی ان کی قانونی ٹیم کو رسائی دی گئی ہے۔ آج پورا دن لواحقین جیل کے باہر منتظر رہے، مگر جیل انتظامیہ نے ملاقات کی اجازت دینے سے انکار کر دیا۔

ہمیں ان کی خیریت اور زندگیوں کے حوالے سے شدید خدشات لاحق ہیں۔

اس غیر انسانی رویے اور بنیادی انسانی حقوق کی خلاف ورزی کے خلاف، ہم لواحقین کل بروز 10 جولائی کو دوپہر 1 بجے سول لائن تھانے کے سامنے پرامن احتجاجی دھرنا دیں گے۔ ہمارا مطالبہ ہے کہ ہمیں فوری طور پر اپنے پیاروں سے ملاقات کی اجازت دی جائے۔
