EU mở rộng hướng dẫn chống rửa tiền đối với công ty tiền mã hoá
Ngày 16/1, Ngân hàng Châu Âu (EBA) quyết định mở rộng phạm vi Hướng dẫn về Chống rửa tiền/Chống tài trợ khủng bố (AML/CTF) đối với các nhà cung cấp dịch vụ tài sản tiền mã hoá (CASP), nhằm đánh giá và giảm thiểu rủi ro từ tội phạm tài chính.

Theo EBA, các công ty tiền mã hoá đang đối mặt với nguy cơ rửa tiền và tài trợ khủng bố do tốc độ giao dịch nhanh và tính ẩn danh của nhiều sản phẩm. Hướng dẫn mới sẽ giúp các nhà cung cấp dịch vụ nhận diện rủi ro thông qua đánh giá mức độ rủi ro cao/thấp dựa trên khách hàng, sản phẩm, kênh phân phối và vị trí địa lý.

EBA giải thích rằng, Hướng dẫn sẽ giúp đồng bộ cách tiếp cận của các nhà cung cấp dịch vụ tài sản tiền mã hoá tại EU để giảm thiểu rủi ro và đảm bảo tuân thủ chuẩn quốc tế. Các cơ quan có thẩm quyền sẽ báo cáo việc tuân thủ Hướng dẫn trong hai tháng. Hướng dẫn sẽ chính thức có hiệu lực từ ngày 30/12, đánh dấu bước quan trọng trong cuộc chiến chống tội phạm tài chính.
Đặc biệt, EBA đề xuất các công ty tiền mã hoá điều chỉnh biện pháp chống tội phạm tài chính, bao gồm việc sử dụng công cụ phân tích blockchain. Hướng dẫn sẽ áp dụng cho cả ngân hàng và tổ chức tài chính liên quan đến tiền mã hoá, đồng thời mở rộng đến các tổ chức tài chính quốc tế, tạo ra một khuôn khổ chuẩn hóa trong Liên minh châu Âu trước những rủi ro thường trực.

Năm ngoái, EU đã hoàn thiện các quy về chuyển tiền mã hoá thông qua Nghị định về Chuyển khoản Quỹ (ToFR), cũng như ban hành Đạo luật về Thị trường Tiền mã hoá (MiCA), dự kiến có hiệu lực vào tháng 12. Tuy nhiên, các quốc gia thành viên EU vẫn có tùy chọn áp dụng giai đoạn chuyển giao kéo dài tới 18 tháng cho các CASP, mang lại sự linh hoạt trong thời gian chờ đợi áp dụng MiCA một cách toàn diện.
