@NicholasMcKern @blazerbanter I responded to your other post. I think we’re actually in agreement lol. The only thing I’m clarifying is that the city shouldn’t waive their rights. They can commit to do so upon an agreement. But you can’t just waive them up front.

The city could, and should, state something like “we are not making any determinations on the “first class” status of the arena, but upon the execution of a new lease we agree to relinquish those rights.”

@NicholasMcKern @blazerbanter The “threat of litigation” exists anywhere there is a contractual agreement. Intent to pursue litigation is different than the right to pursue litigation. You don’t give up your contractual rights because the other party doesn’t like those rights. That’s why they are negotiated.

The team has gifted the city a pile of evidence that the current arena is not “first class.” The current lease says that’s the team’s responsibility. If they leave, the city can sue the team for the money to make it first class.

@NicholasMcKern @blazerbanter The same argument applies to the threat of relocation though. The Blazers could say up front that they will not move the team, but that would hurt their leverage. Why would the city voluntarily surrender their rights, up front, just for the right to negotiate?
