Heads @snv_berlin research on digital rights, surveillance & democracy. Current projects: @aboutintel @guard_int & European Intelligence Oversight Network
Lots of important work ahead for the next German government, including to adjust and reform security and intelligence legislation. In a new report published today, @newsvieth and I call upon the 🚦to SEIZE the moment for comprehensive and rights-based intelligence reform.

The German armed forces use various surveillance methods without legal restrictions or sufficient oversight. In our new blog post, the authors argue, why the governing coalition needs to use the upcoming reform to close this loophole:

2/2 e.g. margin of appreciation? threshold for public emergencies and derogation? tests for limitations/restrictions? extraterritoriality? regulation in specific areas like bulk surveillance? headscarves? Any hive mind thoughts/steers welcome!
1/2 Quick query for international lawyers: for my UNGA report on counter-terrorism by regional organizations I'm interested in examples of regional human rights bodies being (1) more or (2) less protective on national security issues than international/UN human rights law?

In his brilliant post at @Verfassungsblog @marcinszwed89 discusses 'shortcuts' that should be avoided in restoring the rule of law in #PL:
1. ad hod interpretation of law (which allows to find that captured institutions are deemed 'non-existent')
In our first piece, @twetzling & Hannah Aeterna Borne argue that a new statutory framework for the Independent Control Council is needed to protect fundamental rights & to ensure independent & effective oversight across a wider array of surveillance

Q to UK colleagues re: @bricksilk 's recent review of 🇬🇧 IP Act & recommendations.
Is/was there a debate on (a) medium/high expectations of privacy when UKIC uses commercially acquired BPDs (b) the current acquisition standard?
I'd appreciate any leads for an intl comparison.

Deutschlands Nachrichtendienste brauchen eine neue Architektur der Kontrolle, schreiben Konstantin Kuhle und Stephan Thomae in ihrem Gastbeitrag: https://t.co/ndtY2sKZ2Z #BND
Interestingly, according to the piece, the Dutch Intelligence Oversight Body (CTIVD) held a roundtable on this topic. "Although itself cannot act, as it is only charged with overseeing MIVD/AIVD", it sure initiated an important discussion which may inspire others to do the same.
A very interesting piece that sheds light on (what my automated translation programme calls) the proliferation of disjointed government intelligence activities in the Netherlands. https://t.co/qkuwCJx69V
more legislative attention should be drawn to the stark differences regarding the availability of safeguards and data handling requirements for similar activities across different sectors ... and what can be done to better prevent creative non-compliance (forum/regime shopping).
