🚨 Update: Buzbee/Maldonado/Garcia v. Roc nation, Quinn Emanuel, and Marcy Croft
There are several media outlets reporting that the entire case was dismissed, but the docket itself repeatedly references “partial dismissal” orders. Based on the orders currently available, Marcy Croft, MJ Legal, and Quinn Emanuel obtained dismissal under the Texas Citizens Participation Act (TCPA), Texas’s anti-SLAPP statute, which allows courts to dismiss certain claims involving speech, petitioning activity, or matters of public concern. Those dismissals were entered with prejudice, and the court also indicated attorney’s fees would be awarded.
Roc Nation’s dismissal appears to be different. The court found that it lacked personal jurisdiction over Roc Nation regarding claims against them. That is a jurisdiction ruling, not a ruling on the merits of the allegations. In other words, the court did not determine whether the claims were true or false. It determined that this particular Texas court could not exercise jurisdiction over Roc Nation on those claims. It’s possible that’s where partial dismissal came from. They may have wanted to be the dismissed with prejudice. But the judge said Buzbee can refile the claims against Roc Nation elsewhere.
What remains unclear is why the Harris County docket continues to display an October trial date setting on the court’s website. This was a consolidated action involving multiple parties and claims, so it is not yet clear from the docket alone whether any claims remain pending, whether certain issues are still being resolved, or whether the court’s calendar has not been updated.
For now, the confirmed developments are the TCPA dismissals with prejudice for certain defendants and the jurisdictional dismissal as to Roc Nation. I’ll continue monitoring the docket and will check back in a few days to see whether additional orders clarify exactly what remains if any, and whether any claims are refiled in another jurisdiction.
