The draft EHRC Statutory Code of Practice confirmed what many of us already knew: the UK is in violation of its obligations under the ECHR, resulting in trans people being unfairly discriminated against and in violation of their human rights.
But recent events have also confirmed something even more disturbing - all the leading members of the gender-critical ideology movement have strong links to racism (specifically Islamophobia), Tommy Robinson, the Alliance Defending Freedom (ADF), and the far-right.

But where to now for trans folk?
Likely more court battles, and there are plenty of grounds to bring them.
1: Violation of the Gender Recognition Act 2004 “For All Purposes”:
Frameworks or judgments such as FWS v Scottish Ministers that define “sex” exclusively as biological sex for Equality Act 2010 purposes effectively neutralise the GRA 2004’s “for all purposes” rule for GRC holders, undermining Parliament’s clear mandate and creating a fragmented, two‑tier legal status where GRC holders are recognised in their acquired sex for some purposes but not for equality law.
2: Incompatibility with Goodwin v United Kingdom (Article 8 ECHR):
By recognising transgender people with GRCs as their acquired gender in some areas (e.g. marriage, pensions) but treating them as their birth sex in equality law, a biological‑sex‑only standard recreates the “intermediate zone” Goodwin held was unsustainable under Article 8.
3: Breach of the Human Rights Act 1998:
Enforcing a biological‑sex‑only standard in equality law is, on this analysis, incompatible with the duties in the Human Rights Act 1998: Section 3 (to interpret legislation compatibly with Convention rights where possible) and Section 6 (for courts and other public authorities not to act incompatibly with those rights).
4: Structural Conflict with Privacy Protections (GRA Section 22):
Applying a biological‑sex‑only standard in practice incentivises or requires enquiries into who holds a GRC, creating functional incoherence and structural tension with the GRA 2004 Section 22 privacy offence, which assumes GRC holders will ordinarily be treated as their acquired sex.
In short, the present legal confusion can only be resolved in one of two ways: either Parliament clarifies that GRC holders are to be recognised in their acquired sex under the Equality Act (as before FWS), or the courts are asked to declare the FWS v Scottish Ministers interpretation is incompatible with other legislation.
So let me get this straight. If I as a cis man wanted to assault a woman in a restroom, I could now just claim I’m actually a biological woman who looks like a man because I have transitioned and go assault that woman, right? Also, since when was this a barrier for me anyway?
What kind of society have I just become a citizen of? This is disgraceful, disgusting and horrific. Trans women are women trans men are men. Non-binary people exist as to intersex people. None of this makes woman safer. They weren’t in danger anyway.
