Salve. Assista. Compartilhe.
You've had a letter from HMRC about your Bitcoin or crypto.
It's polite. It's vague. There's a form to sign.
Before you sign anything, read this.
First, what the letter is.
HMRC has data. Exchanges operating in the UK have handed over names, addresses and transaction data under information powers.
They've matched it to your record and found no Bitcoin or crypto disposals reported.
What the letter is not: an enquiry.
Nobody has opened a formal investigation into you. No assessment has been raised. No penalty is in play yet.
That distinction matters enormously, and it's about to matter more.
Enclosed is usually a Certificate of Tax Position. Three tick boxes, one signature.
There is no legal obligation to sign it or return it.
HMRC does not tell you that in the letter.
Why the certificate is a trap.
It's a signed statement of fact with no de minimis and no time limit. Tick the wrong box on something you'd forgotten from 2018 and you've made a false declaration.
That moves you from a tax problem to a potential criminal one.
The professional bodies have said as much for years. The advice from CIOT and ICAEW has been consistent: don't sign it.
I don't sign them for clients. I write instead.
So what do you actually do?
Step one: don't ignore it. Silence gets read as evasion and invites a formal enquiry with worse terms.
Step two: don't panic-file something wrong. Rushed disclosures create their own problems.
Step three: send a holding response.
A short letter acknowledging the nudge, declining the certificate, and stating you're reviewing your position and will revert within a set period.
That buys you time and preserves your status.
Why that status is worth real money.
Disclose before HMRC opens an enquiry and it's unprompted. Disclose after and it's prompted.
The penalty ranges are materially different. Same tax, same facts, different outcome.
Step four: actually do the work.
Rebuild the pool. Every wallet, every exchange, every year. Not one CSV and a guess.
Half the nudge letters I see turn out to be a loss year once the cost base is properly reconstructed.
Then, if tax is owed, disclose properly through the right channel with a full computation and a considered penalty position.
If nothing is owed, you say so in writing, with evidence, and close it out.
The letter is not the problem. The reflex is.
Signing to make it go away is how a solvable compliance issue becomes a twenty year assessment window.
If one has landed on your doormat, don't sign it. https://t.co/ywQ79xk79x or message me
@The_Bunny_Doll@PrioryGroup Clarification for strangers, I'm no longer Bun's therapist but anything I can do as a friend I will. Bun I'm really proud of you for how your handling all this!
@The_Bunny_Doll That moment when your therapist remembers his suicide pact. Truths aside, I know you will figure this out Bun and I have to believe you make it bc the best future ahead is the one with you in it. You should contact @PrioryGroup, have you spoken to the head of their peer support?
@The_Bunny_Doll Remember then VS now.
Log flashbacks on nowness and distress. Examine them, ask yourself what was surprising/different about them.
And most importantly know that it's understandable and okay to not be okay sometimes. Zoom out your progress is incredible 🔥 🔥 🔥
@The_Bunny_Doll One thing we could try when we're able to resume sessions is a "new me" formulation. After understanding your timeline and opening a new chapter, think of a spider diagram with "new me" in the centre.
Branch it out, be hopeful and creative.
Anywyay all for now BYE
