आपका “कड़वा सच” आधा सही है, आधा अधूरा। संविधान ने अनुसूचित जाति/जनजाति को सूचीबद्ध किया है यह सच है, और कोई भी नेता उसे रातोंरात नहीं मिटा सकता। लेकिन संविधान “आरक्षण हमेशा जाति पर ही रहे” नहीं कहता।
सुप्रीम कोर्ट ने खुद Janhit Abhiyan (2022) में 3:2 से साफ कहा कि आर्थिक आधार पर आरक्षण संविधान के बुनियादी ढांचे के खिलाफ नहीं है। सभी पांच जजों ने माना कि आर्थिक मापदंड पर आरक्षण वैध हो सकता है। Indra Sawhney (1992) में आर्थिक अकेले को पर्याप्�� नहीं माना गया था , लेकिन 103वें संशोधन और उसके बाद के फैसले ने रास्ता खोल दिया।
2024 के Davinder Singh फैसले में सब-क्लासिफिकेशन की अनुमति दी गई और कई जजों ने SC/ST में भी creamy layer निकालने की जरूरत बताई। 75 साल बाद भी क्या हम जाति को स्थायी पहचान बनाकर रखेंगे या गरीबी को लक्ष्य बनाएंगे? स्टार्टअप जरूर करें, लेकिन व्यवस्था को भी सुधारने का अधिकार हमारा है।

#ReservationReformआंदोलन सिर्फ जंतर मंतर नहीं, संवैधानिक और राजनीतिक ��ास्ता भी है।

◦अनुच्छेद 15 और 16 में बदलाव करके (या नए क्लॉज जोड़कर) आरक्षण को मुख्य रूप से आर्थिक मापदंड पर लाया जा सकता है।
◦EWS (10%) पहले ही आर्थिक आधार पर है और SC ने इसे बरकरार रखा। इसे बढ़ाकर या जाति-आधारित ��ोटा को चरणबद्ध तरीके से आर्थिक + सामाजिक मापदंड में बदलने का प्रावधान किया जा सकता है।
◦अनुच्छेद 341/342 की सूची (SC/ST) संसद ही बदल सकती है कोई कोर्ट या राज्य नहीं। संसद चाहे तो सूची की समीक्षा, समय-सीमा या creamy layer लागू कर सकती है।
◦राजनीतिक इच्छाशक्ति + व्यापक जनसमर्थन से यह संभव है (जैसे 103वां संशोधन हुआ)।
2सुप्रीम कोर्ट के जरिए दबाव
◦Indra Sawhney में economic alone को सीमित माना गया था, लेकिन Janhit Abhiyan ने साफ कर दिया कि आर्��िक आरक्षण वैध है।
◦Davinder Singh (2024) में सब-क्लासिफिकेशन मंजूर; कई जजों ने SC/ST में creamy layer की सिफारिश की। इसके आधार पर PIL दायर करके “एक परिवार-एक बार”, आय सीमा, और आर्थिक प्राथमिकता की मांग की जा सकती है।
◦हाल ही में (2026) केंद्र ने SC/ST/OBC में सिर्फ आय-आधारित प्राथमिकता और SC/ST creamy layer का विरोध किया है यह दिखाता है कि मुद्दा अभी अदालत में जिंदा है। डेटा (आर्थिक सर्वे, NFHS, PLFS) के साथ च���नौती दी जा सकती है कि लाभ अमीर तबके तक सीमित हो रहा है।
•Sinho Commission (2010, Major Gen. S.R. Sinho): UPA सरकार द्वारा गठित। इसने साफ कहा कि सिर्फ आर्थिक आधार पर backward class की पहचान करके रोजगार/शिक्षा में आरक्षण नहीं दिया जा सकता , यह संवैधानिक और कानूनी समझ के खिलाफ है। Economically Backward Classes के लिए कल्याणकारी उपाय (welfare measures) की सिफारिश की, आरक्षण की नहीं। 50% सीमा को भी बाध्यकारी माना (जब तक SC या संशोधन न हो)। EWS आरक्षण बाद में संशोधन से आया, Sinho न��� उसे सीधे सपोर्ट नहीं किया।16
• Kaka Kalelkar Commission और Mandal में भी आर्थिक मापदंड शामिल थे लेकिन मुख्य रूप से सामाजिक-शैक्षणिक। कुछ पुरानी सलाहकार समितियों ने लंबे समय में economic yardstick की ओर बढ़ने की बात कही थी, लेकिन लागू नहीं हुई।

पूरी तरह जाति-मुक्त सिर्फ आर्थिक आरक्षण अभी संवैधानिक रूप से आसान नहीं है लेकिन, EWS मॉडल का विस्तार, creamy layer का सख्ती से लागू होना, और चरणबद्ध सुधार संभव है। आंदोलन को कानूनी सलाह, डेटा और राजनीतिक गठबंधन के साथ आगे बढ़ाना चाहिए।

If money is the problem, then govt should reduce the freebies budget. Defence comes first.

Time to bring changes to Reservation system-

2. #OneTimeReservation- use either for studies or jobs
3. Sunset clause- Reservation should end after specific period
