மணிப்பூரில் இந்திய ராணுவத்தை அவமதிக்கும் விதமாக அஸ்ஸாம் ஃரைபிள்ஸ் துணை ராணுவப் படைமீது மணிப்பூர் பாஜக அரசின் காவல்துறை வழக்கு பதிவு செய்துள்ளது. ராணுவத் தரப்பில் மணிப்பூர் காவல்துறையின் குற்றச்சாட்டை மறுத்துள்ளனர். மணிப்பூர் போலீஸ் ஒரு சார்பாக இருப்பதும், நிர்வாணமாக ஊர்வலம் விடப்பட்ட பெண்களை அவர்கள்தான் ஆயுதம் தாங்கிய மெய்த்தி கும்பலிடம் ஒப்படைத்தனர் என்பதும் அந்தப் பெண்களின் வாக்குமூலத்தால் அம்பலமாகியுள்ளது. உச்சநீதிமன்றம் தானே முன்வந்து விசாரிக்கும் வழக்கில் மணிப்பூரில் பதிவு செய்யப்பட்டுள்ள வழக்குகளை மேற்பார்வை செய்ய பல்வேறு குழுக்கள் அமைக்கப்பட்டுள்ளன.
இந்நிலையில் ‘அஸ்ஸாம் ஃரைபிள்தான்’ அங்கு கலவரம் பரவாமல் கொஞ்சமாவது தடுத்து வருகிறது. இந்நிலையில் துணை ராணுவப் படையையே அவமதிக்க மணிப்பூர் பாஜக அரசு முனைந்திருப்பது அதிர்ச்சி அளிக்கிறது. இதைப்பற்றி அவையில் விவாதிக்க வேண்டும் என நானும் @WriterRavikumar அவர்களும் கவன ஈர்ப்பு நோட்டீஸ் அளித்துள்ளோம்

Kesavananda Bharati judgement and Basic structure doctrine
=======

The Kesavananda Bharati judgment has played a crucial role in safeguarding the Constitution of India. This judgment, which was delivered on April 24, 1973, established the 'Basic Structure' of the Constitution and ruled that no amendment could be made in Parliament to modify it.

Currently, the ruling BJP government views the concept of 'basic structure' as defined in the Kesavananda Bharati case as a major obstacle. The judgment itself impedes their desire to declare India as a Hindu Rashtra. This is why the Indian Union Law Minister, Mr. Kiran Rijiju, and the Vice President of India , Mr. Jagdeep Dhankhar , have been criticizing the basic structure doctrine.

Although Chief Justice of India Hon’ble Chandrachud did not directly respond to the BJP's criticism of the basic structure of the Constitution, he stated that “The basic structure of our constitution, like the north star, guides and gives certain direction to the interpreters and implementers of the Constitution when the path ahead is convoluted."

The BJP aims to create an authoritarian Sanatan state in India and is attempting to destroy the Constitution that obstructs its agenda. To achieve this, they use two different strategies: first, they intimidate honest judges in the name of criticism of the judiciary, and second, they impose individuals who are close to them as judges. Against this backdrop, we can see that the BJP's criticism of the Constitution's ‘ basic structure ‘ is part of a more extensive sanatan strategy.

At this crucial juncture, preserving the independence of the judiciary and the basic structure of the Constitution has become one of our primary responsibilities. This day (24th April,2023) marks the golden jubilee of the Kesavananda Bharati judgment, and it is with this in mind that this webinar is being organised by VCK.
