#India: We are concerned by reports of mass detentions of demonstrators, protest leaders, members of civil society organisations, lawyers and journalists, before and during today’s large-scale demonstrations in Delhi.
We call on the authorities to ensure that the right to peaceful assembly is fully respected and fulfilled.

One important thing to understand is that the legal architecture around the right to protest in India remains colonial in its design, and the Supreme Court has been enforcing this colonial architecture since 1960. The Constitution did nothing to change this.
All Mail and Express trains scheduled to arrive at New Delhi and Nizamuddin Railway stations in the national capital between 4 a.m. and 2 p.m. on Saturday (October 10, 2026) have been cancelled “in view of anticipated severe road traffic congestion” in the areas, the Ministry of Railways said.

Not allowing protests against the Election Commission in Delhi is a clear violation of the fundamental right to protest peacefully, says former Supreme Court judge Madan Lokur.
Speaking to DeKoder, Justice Lokur, who also heads an independent commission of former judges to look into the controversial SIR exercise, said the top court should take cognisance of what is happening in the Capital and ask why people are not being allowed to protest peacefully. If the Supreme Court can take up the issue of stray dog bites on its own, it can take up this issue, which is of national importance, he said.
Talking about the Supreme Court’s actions on the SIR, Justice Lokur said it was “a very unfortunate comment that if you can't vote this time, maybe you can vote next time.” He was clear that the Election Commission was not all-powerful.
