“SMTA is a joint signatory to the plea seeking a separate Medical Devices Act. We have consistently opposed the inclusion of medical devices under the Drugs and Cosmetics Act and had challenged the 2020 notification, including before the Supreme Court. Medical devices are engineering products and require a distinct, risk-based regulatory framework, not a pharmaceutical regulatory approach.

The present Bill was an opportunity to correct this anomaly, but retaining medical devices within the same overarching law, even with a separate wing, continues to create complex and onerous compliance requirements. This is particularly burdensome for India’s micro and small medical-device enterprises and could ultimately hurt competition, innovation and increase healthcare costs. We therefore urge the Government to delink medical devices from drugs and establish a separate Act with an independent regulator,” said **Puneet Bhasin, President, Surgical Manufacturers & Traders Association (SMTA)**.

Do we need any Drug licence/form 41 or any other compliance for this Medical store/Clinic/Health centre but you need one to sell authentic Medical Devices

Applications and audits completed months back... this is not how we are going to get to $50Bn

The regulations, must be matured through a through stakeholder consultation and then implemented only after education. The steps are Engineering, Education and Enforcement.
