Just in: Court Grants Peter Obi Leave to Serve Kenneth Okonkwo Through Substituted Means

An Anambra State High Court sitting in the Onitsha Judicial Division has granted Mr. Peter Gregory Obi, leave to serve court processes on Mr. Kenneth Okonkwo through substituted means.

The order was made by Hon. Justice D.A. Onyefulu on June 30, 2026, in Suit No. O/229/2026 and Motion No. O/1322M/2026.

The ex parte application was moved by counsel to the plaintiff, Chisom Ibemesi, following an affidavit deposing to unsuccessful attempts by the court bailiff to personally serve the defendant with the originating court processes.

In the ruling, the court granted leave for the writ of summons and all accompanying or subsequent processes to be served by pasting them at the defendant’s last known residential address at NPR 48 Ofuluonu, Nsukka, Enugu State, near Ijeoma Fishing Company, or by delivering them to any adult found at the address.

Justice Onyefulu further directed that photographic evidence of the substituted service be taken and filed before the court as proof of compliance.

The court ordered that the service be effected within seven days from the date of the order.

The application was brought pursuant to Sections 6 and 36 of the Constitution of the Federal Republic of Nigeria, 1999 (as amended), and the relevant provisions of the Anambra State High Court (Civil Procedure) Rules, 2019.

The order clears the way for the suit instituted by Obi against Okonkwo to proceed after unsuccessful efforts to effect personal service on the defendant.

The substantive issues in the suit are yet to be heard by the court.

A high court in Anambra state has granted Peter Obi, presidential candidate of the Nigeria Democratic Congress (NDC), leave to serve court processes on Kenneth Okonkwo, a chieftain of the African Democratic Congress (ADC), through substituted means in an N8 billion “defamation” suit.

D.A. Onyefulu, presiding judge, gave the order on Tuesday after hearing an ex parte application filed by Chisom Ibemesi, @PeterObi’s counsel,

The judge granted the application after considering an affidavit showing that efforts by the court bailiff to personally serve the processes on Okonkwo were unsuccessful.

An Anambra State High Court has granted Peter Obi leave to serve a ₦5 billion defamation lawsuit on his former spokesperson, Kenneth Okonkwo, via substituted means.

Justice D.A. Onyefulu permitted the suit to be pasted at Okonkwo’s last known address in Nsukka, with photo evidence filed in court. The suit stems from allegations by Okonkwo that Obi demanded bribes from aspirants, which Obi denied

The order followed an ex parte application filed by Mr Obi through his lawyer, Chisom Ibemesi, after his initial efforts to serve Mr Okonkwo failed.

The court permitted Mr Obi to serve the writ of summons and subsequent documents by pasting them at Mr Okonkwo’s last known residential address, NPR 48 Ofuluonu, Nsukka, Enugu State, close to Ijeoma Fishing Company, or by delivering them to any adult at the residence.
