The question now is which of the amici curiae is most credible. We know that even former justices can have political and personal biases that may influence their views.

It simply means that if a senator was unable to participate for whatever reason, that senator may cast a vote of abstention, but should not thereby be deprived of the right to vote.

If you unfairly deprive a senator of his right to vote, you do not silence only one man. You disenfranchise the people who elected him.

In determining the voting threshold, make sure you do not effectively deprive senators of their right to vote simply because they are absent, especially when their absence may not be of their own choosing.

The amici curiae hearing was supposed to resolve the number of votes needed to convict. Instead, the four retired justices offered different schools of thought. The situation has become more confusing.
