‘DAPAT TWO-THIRDS NG MGA FUNCTIONAL SENATORS.’

Atty. Howard Calleja says the two-thirds voting requirement for conviction in the impeachment trial is constitutionally mandated, but argues that the threshold should be based on senators who are currently serving and functioning.

Speaking on BNC’s #MiddayReport, Calleja says that with 20 functioning senators at present, the two-thirds threshold should be based on that number, rather than automatically using the full Senate membership.

Some senators are currently unable to participate, including Sen. Loren Legarda, who is overseas on medical leave; Sen. Ronald 'Bato' dela Rosa, who is in hiding amid an ICC arrest warrant; Sen. Jinggoy Estrada, who is detained over his alleged involvement in the flood control scandal; and Sen. Rodante Marcoleta, who is facing questions over P75 million in undeclared campaign donations.
