A driver isnt shielded by the banner of thr company they work for anymore. They are not one party, they are separate in split percentage judgments...

A carrier will do whatever they can to minimize liability on the company, and that includes attributing as much "preventability" on the driver as possible even in situations where the driver may not have been at-fault for the crash/incident.
