BREAKING🚨 Judge Carro's MIXED Decision on Suppressed Evidence:
According to Judge Gregory Carro, the following evidence recovered during the initial backpack search at the Altoona McDonald’s must be suppressed because the warrantless search was unlawful under New York law:
Loaded handgun magazine
Cellphone
Passport
Wallet
Computer data chip / microchip
The judge also suppressed certain statements Mangione made after the court determined he was effectively “in custody” around 9:47 a.m. while surrounded by officers at McDonald’s.
Suppressed statements include:
Responses explaining why he lied about his identity
Statements about possessing a fake ID
Certain post-custody responses to police questioning before valid Miranda compliance
Evidence & Statements KEPT / ADMISSIBLE
Judge Carro ruled prosecutors may still use substantial evidence recovered later during the Altoona Police Department stationhouse inventory search, which he found lawful.
Admissible evidence includes:
Alleged 9-millimeter ghost gun / firearm
Silencer
Red notebook / journal
USB drive
Pocket knife
Various papers and writings
Clothing and other inventoried items recovered at the stationhouse

The defense has arrived: Karen Friedman Agnifilo, Marc Agnifilo and Jacob Kaplan. Mangione's jail consultant, Craig Rothfeld is sitting in the front row of the gallery as well. The defense seems like they are in good spirits, fyi. The decision hasn't been posted yet to my knowledge, however.
