Demand for Transparency in Supreme Court Appointments:-

It is now a matter of public record that Justice Alok Aradhe, Chief Justice of the Bombay High Court, ranks only 5th in all-India seniority among High Court judges, and Justice Vipul M. Pancholi, Chief Justice of the Patna High Court, ranks 57th. Yet both were recommended for elevation to the Supreme Court by the collegium.

While there is no dispute that the collegium considers factors other than seniority, these elevations raise important questions:

1. Why have many senior judges been bypassed? Seniority is not the sole criterion, but jurisprudence (e.g., Second Judges Case) emphasizes that supersession should be justified by “strong and cogent reasons.”

2. What exceptional qualities or contributions justify these two elevations over senior peers? Without clear reasons disclosed, the process appears opaque and discretionary.

3. Why is there no proactive disclosure of the selection criteria? The collegium often cites factors like regional representation, diversity, integrity, and quality of judgments. If these are the basis here, the public deserves to know.

These concerns are not about the personal merit of any judge; rather, they highlight the need for accountability and trust in judicial appointments. As former judges and scholars have argued, the collegium’s secrecy undermines confidence in the system. Transparency reforms have been debated for years, and the Supreme Court itself has acknowledged the need to publish resolutions and reasons, but practice still falls short of meaningful disclosure.

In a healthy democracy, judicial independence and transparency must coexist. The public has a legitimate interest in knowing why certain judges are preferred over others—especially when multiple senior judges, including senior women judges, are overlooked.

I therefore call upon:

The Supreme Court collegium to disclose clear reasons for any supersession, consistent with constitutional principles.

The Government of India and Parliament to consider systemic reforms that enhance transparency without compromising judicial independence.

Civil society and media to debate these issues openly to ensure public trust in one of our most vital institutions.
