Safaricom has already been sold, in a rushed transaction concluded while a constitutional petition still awaits determination before the High Court.
The National Treasury proceeded to dispose of the Government’s 15% stake to Vodacom almost immediately after the lifting of conservatory orders, despite the matter having been fully heard and a ruling expected within weeks. This transaction has therefore been concluded under a cloud of unresolved constitutional questions.
The Court of Appeal did not pronounce itself on the legality of the sale, the adequacy of public participation, or the fairness of the valuation. Yet, before the High Court could determine these substantive issues, the asset at the centre of the dispute was transferred.
This raises serious concerns about respect for due process, public accountability, and the protection of national assets. Safaricom remains a strategic pillar of Kenya’s digital economy, and the circumstances surrounding this sale continue to raise fundamental questions that remain before the courts.
