Per @MaryAnnreports and @DailyMail the Defense did raise the "sudden passion" affirmative defense at the penalty phase to attempt to get a relegation back down to Manslaughter per § 19.02(d) which is one of only a very few good decisions they've made in this trial
@cartierfamilyZ No shock at the verdict. Sadly, no shock at the blind equivocating and no shock at the vengeful and sometimes outright racist gloating either. We can do better than this.
@queenie4rmnola No disagreement with this. And for my advice for people that are happy right now and celebrating, take a minute to look in the mirror and see if you can find it in your heart to cry and pray for Karmelo and his family too. He has 3 young siblings I think that just lost a brother
@LawrenceBJones3 Correct and tragic. I’m quite disappointed in the way people are celebrating the vengeance. Justice is blind and dispassionate. Correct decision, just decision, and somehow the world around me is still worse off for it, I think.
@AshleighMerchan Thanks for these thoughts @AshleighMerchan. This is a stone faced truth. I’m very displeased at those that celebrate this and the racist gloating. We are still are very vengeful society. But, when one seeks revenge, always dig two graves - as they say. Justice was served…I think
@tariqnasheed Stop this. Karmelo’s not bad. He was wrong. Defense attorneys did not advocate well and he declined to testify. We can’t be so blind to believe that 20+ witnesses are conspiring. Isn’t it much more likely that he committed the act? Doesn’t mean I’m ready to throw him away though.
@_LaJanee_ The penalty phase still has some legal maneuvers that can reduce charges/time or at least preserve for appeal. Further poor form by defense not humanizing him more with character witnesses. Not even his father? I think rehabilitation is possible and remorse is genuine.
@jdmiles11 Will Defense raise 19.02(d) during penalty phase and speak about sudden passion to reduce the degree of felony? I’ve heard this is done and the Judge has the discretion to reduce to manslaughter though I’d expect he gets every bit of the 20. Raise it or waive it.
@MAGAVoice I don’t agree with invoking Jesus today to celebrate this punishment. He should be part of the equation for sure because healing is sorely needed for two families, two schools and one community. And there is a 19 year old that needs his protection and love now more than ever.
@MaryAnnreports I feel deeply sad for his mother, father and siblings. I feel deeply sad for Austin’s identical twin brother Hunter and his parents and family. God bless all of them - and Karmelo too. This was avoidable in so many ways and is a heartbreaking tragedy.
