The part of these stories that is appalling is that it’s going to have sway with folks that have no clue about the intricacies of immigration.

Once you’re in the US, your visa stamp no longer is relevant…at all. What matters is it you have a valid I-94 or have a timely filed extension or change of status, green card application, or in this case an asylum application.

Those filings put you in a period of authorized stay while pending. Yet, because ICE is hiring unqualified amateurs who do not receive enough training, and the leadership that knows better have Miller et al. breathing down their necks to increase arrest numbers you end up here. Add those up, you get BS arrests, terrorizing people that are doing things the right way, but stuck waiting…plenty because of Joe Edlow’s delays.

You better believe I’m including this new BS as a harm in my delay lawsuits moving forward. Folks need timely adjudications so ICE’s amateurs don’t detain them at airports.

DHS needs to train better and end this new tactic.
