This is incredibly disappointing to see, but also not surprising - it’s just visible evidence of how broken constitutional litigation is in India, and has been for a while (and why, after every law, people beg others not to rush to the SC - but to no avail).

Yesterday, I was overwhelmed by the support I received for my speech in Parliament. Many of you shared it widely, I had not posted it myself. I am now sharing the full speech again so those who missed it can watch how this government is excluding and targeting some of the most marginalised sections of our society.
The fight will continue. We will not allow the rights of the LGBTQIA+ community and transgender persons to be diluted, and we will ensure that their dignity, identity, and constitutional protections remain intact.
This Bill is a double assault on the transgender community’s dignity and rights:
• While every MP in Parliament self declares their gender without scrutiny, transgender citizens are being forced to prove their identity before a medical board and the District Magistrate
• From childhood, we are boxed into blue for boys and pink for girls, but identity is deeply personal and constitutionally protected
• At a time when the LGBTQIA+ community is still fighting for recognition of same sex marriage, this government is taking us backwards by removing even the right to self identification
• No meaningful consultation with the transgender community or stakeholders, despite Supreme Court led processes
• The Bill invades privacy, enables discrimination, and opens the door to criminalisation
This is not reform, this is regression. Not protection, but policing of identity.
As Mahatma Gandhi reminded us, “The true measure of any society can be found in how it treats its most vulnerable members.”
👉 Did the Centre hold any kind of consultation or discussion with the transgender community?
👉 I request that the government respect the existing NALSA judgement of the Supreme Court.
👉 Have the courage to stand up and say, “Yes, this was a mistake, and the Bill will not be brought forward.”

A Supreme Court-constituted Advisory Committee headed by former Delhi High Court judge Justice Asha Menon has sent a resolution to the Government of India, requesting that the Transgender Persons (Protection of Rights) Amendment Bill, 2026, be withdrawn -

The BJP government’s Transgender Persons Amendment Bill is a brazen attack on the Constitutional rights and identity of transgender people.
This regressive bill:
- strips transgender people of their ability to self identify, violating a Supreme Court judgement
- wipes out the diverse cultural identities of communities across India
- forces trans people to undergo dehumanizing examinations by a medical board
- introduces criminal penalties and surveillance without safeguards
The BJP government hasn’t consulted the trans community and brought a bill which stigmatises rather than protects them.
The Constitution protects every Indian’s right to life, liberty, identity, and dignity. This BJP government is violating our Constitution and destroying India’s rich history of honouring transgender communities in pursuit of its narrow ideas.
The Congress Party unequivocally opposes this Bill.
We, the members of the @VBAforIndia express grave concerns and strong opposition to the proposed legislative amendments to the Transgender Persons (Protection of Rights), 2019 being sought through the Transgender Persons (Protection of Rights) Amendment Bill, 2026.
The proposed amendments restructures the existing law in a manner that weakens legal recognition, restricts access to identity by undermining self-determination, introduces a medicalised framework, infringes upon privacy, and incorporates provisions that further stigmatises and criminalises the transgender community by incorporating social notions and stereotypes.
The proposed amendments, if enacted, will nullify the very limited progress made in transgender rights, welfare, and reverse decades of advocacy for recognition, dignity, self-respect, inclusion, justice and empowerment for the transgender persons.
The members of the VBA call for the withdrawal of the Bill with immediate effect as it is draconian, repressive, unconstitutional, arbitrary, and, most importantly, inhumane.
