$NBIS: lawsuit in Birmingham, Alabama to resume on August 12.

The City, Nebius and Hoar Construction were sued over allegations that the city illegally permitted the project. The preliminary injunction hearing to halt construction was held on July 14–16 and will resume next week.

The plaintiffs argue that the site sits in a mixed-use zoning area, which requires the use case of the project to be part of an enumerated list. None of "data center," "hyperscale data center," or "AI factory" is part of it, making the permits illegal. A gap the city itself only closed when it passed new data-center regulations in June, following a moratorium triggered directly by the Nebius project.

The city and Nebius counter that the ordinance empowers Katrina Thomas, director of Birmingham's Planning, Engineering and Permitting Department, to "categorize new land uses not enumerated in this title according to the most comparable land use classification."

The plaintiffs' attorney, Mark Parnell, argues Thomas should have known a hyperscale facility didn't belong in that category, since her own office's investigation is what prompted the city to seek a moratorium in the first place.

Thomas testified that because data centers had previously been permitted in Oxmoor Valley under that same zoning, she had little choice: "The use of their property was permitted. To deny a permit, even though they meet the requirements of the ordinance, would be arbitrary on our part."

Judge Crayton has set aside all of August 12 to finish the hearing.

A separate lawsuit, filed by the Greater Birmingham Humane Society, is also seeking judicial review of the project's approvals and permits, driven by concern over noise, heat, and light from the facility affecting animals at its planned adjacent campus.
