At the seminar “Taxation Controversy of Celebrities’ One-Person Agencies,” held on April 10 and reported by Tax Daily, Kang Seung-yoon, a tax expert, argued that investigations into celebrities’ one-person agencies should only proceed after courts establish clear legal standards. His argument is based on legal inconsistency: he cited a 600 million KRW stock transaction case where the National Tax Service imposed taxes on hundreds of companies, but courts later overturned many of those decisions. From his professional perspective, this shows that the tax authority is acting before legal interpretations are fully settled, which creates risk for taxpayers operating under complex structures like artists.
In the same seminar, Lee Nam-kyung, representing the entertainment industry, argued from an industry standpoint that one-person agencies are not tax evasion tools but legitimate management systems. His reasoning is based on how the entertainment sector actually operates: artists often need separate entities to manage assets and activities outside traditional agency contracts. He emphasized that there is no clear administrative definition of these corporations, and that tax authorities rely on outdated criteria such as physical office space and resident staff, which do not fit artists whose “workplace” is constantly changing. He further explained that many professional expenses—such as styling, beauty, self-development, security personnel, and image maintenance—are essential for an artist’s career but are frequently reclassified as personal spending by tax authorities. From his perspective, this misclassification leads to unfair taxation. That is why he called for concrete solutions: establishing legal status for one-person agencies, introducing a three-party contract model, creating tax guidelines such as expense recognition ratios based on revenue, and even forming a public-private monitoring system to ensure consistent oversight.
Outside the seminar, Tax Watch provides data that supports these concerns at an institutional level. In 2025, the Tax Tribunal handled 4,650 cases, while only 373 cases went through internal National Tax Service procedures, a gap of about 12:1. This suggests that taxpayers, including professionals and businesses, do not trust internal review systems. Additionally, the acceptance rate for taxpayer protection requests was only 16.4%, indicating that most objections are not successful. The report also includes criticism that the National Tax Service sometimes defends its own decisions aggressively and may overstep in its treatment of taxpayers and their representatives.
This broader pattern is reinforced by another Tax Daily report, which shows that the acceptance rate for pre-assessment reviews in cases exceeding 500 million KRW dropped from 53.6% in 2023–2024 to 28.2% in 2025, the lowest in five years.
