The court found that BPM failed to pay promised settlement earnings, with each member allegedly owed over ₩100 million. Judges specifically rejected BPM's defense that financial difficulties caused by an alleged management-rights dispute and media reports justified the non-payment, ruling those issues were unrelated to the artists.
The court also criticized BPM's settlement disclosures, noting the company provided only revenue and expense figures without supporting documents such as invoices or receipts, and failed to explain how the members could verify the records.
As a result, VIVIZ can now continue independent activities while the main lawsuit proceeds.
