Woah! Is this the first time a litigant has publicly boycotted a judge and their courtroom? In his letter to Justice Swarana Kanta Sharma, Kejriwal states that not only will he not be participating in the present CBI Discharge case, but also not appear in any case related to BJP, RSS, and those in which SG Mehta appears in the future. He calls it a Satyagraha and is ready to face any consequences that may follow because of his stand.

Whatever be the ending of this, seeing a politician not budge and take on a High Court judge in a case where conflict-of-interest is as clear as daylight is something to watch. “The principle that justice must not only be done, but must also be seen to be done, is among the most sacred assurances that a court gives to a citizen in a democracy. Respectfully, that assurance cannot be dishonoured by asking the citizen to ignore what anyone can plainly see in a case like this.” Indeed.

अब दो राह है। या तो जस्टिस शर्मा अब भी ख़ुद को केस से हटा लें, या बचाव पक्ष की दलील सुने बिना जो उचित समझें फ़ैसला दे दें।

फिर जब मामला सुप्रीम कोर्ट में जाएगा तो बात सिर्फ़ इस मामले के गुण दोष पर नहीं होगी। मुद्दा तो ये भी उठेगा कि किसी भी मामले से ‘जज ख़ुद को कब और क्यों अलग करें’ क्यों न इसके लिए कोई ‘सुप्रीम दिशानिर्देश’ तय हो!

Recusal application में अरविंद केजरीवाल जी ने 10 points माननीय अदालत के सामने रखे।

उनमें से एक साधारण बात, जो आमतौर पर समझ में आती है, यह है कि Justice Swarnkanta Sharma जी के दो बच्चे हैं। दोनों बच्चे केंद्र सरकार के पैनल के वकील हैं, जो सुप्रीम कोर्ट और हाई कोर्ट में प्रैक्टिस करते हैं।

Solicitor General Tushar Mehta, जो कि केजरीवाल जी के मामले में ED और CBI की तरफ से वकील हैं, यह तय करते हैं कि पैनल में किस वकील को कितने cases मिलेंगे।

इस पर केजरीवाल जी ने कहा था, “यह मेरे मन में संदेह पैदा करता है कि यह conflict of interest है।” इस benefit की वजह से हमारे मन में एक reasonable apprehension पैदा होती है कि क्या उस Solicitor General के पक्ष या उनके खिलाफ फैसला देते समय यह कोर्ट bias नहीं होगी।

CBI और कोर्ट ने भी यह माना है कि ये facts तो सही हैं।
