I warned yesterday that the decisive test for Brazil would come AFTER the election. Would Brazil return to normal democratic competition or follow Venezuela’s path after December 2015?

That test applies regardless of who ultimately wins or loses the contested election.

Last night, Lula used his victory speech to promise greater regulation of social media platforms he accused of interfering against him. Today, his opponent—who is challenging the result—says Alexandre de Moraes has ordered him to surrender his passports and forbidden him from leaving Brazil.

Venezuela’s warning is precisely this. After the opposition won parliament in December 2015, courts became instruments of Maduro for stripping that victory of its practical meaning. Democratic institutions retained their names while entirely losing their independence. Maduro never left until he was removed by force.

Lawfare becomes a means of consolidating power when opponents can participate in elections but cannot safely challenge those who govern.

This is what the U.S. and other governments should examine as it weighs recognition. The question extends beyond the tally to whether Brazil will preserve meaningful political competition afterward.

If Brazil is returning to normal, demonstrate it Lula and Moraes. Protect lawful dissent, permit election challenges and justify every restriction through evidence and due process.

Winning an election, if Lula even won it, would confer authority to govern. It confers no authority to extinguish the opposition.

Let’s make sure the entire world understands. In Brazil, judicial rulings in connection with federal elections are made by the court that has been in place for that very purpose, the Supreme Electoral Tribunal (TSE).

@LulaOficial requested to the TSE that the polls be extended by two more hours in the entire country, citing “transportation problems.” Who controls the transport system? Lula’s government surely more so than a senator running for president.

Instead of waiting for a TSE ruling. @LulaOficial immediately asked Brazilian Supreme Court (STF) justice @Cristianozaninm to order the polls remain open WITHOUT any TSE ruling. Within minutes (did Zanin even read the filing?), the polls were ordered to remain open by Zanin.

The STF has 11 justices. What did Zanin do before becoming an STF justice? Oh yes, he was Lula’s criminal defense lawyer in his corruption cases.

If this blatant rigging of the elections will be used to announce that Lula won, is Lula seriously expecting anyone in the international community to recognize that as a free and fair election? He knows nobody will.

Has the desperation reached a point that today is the day the mask fully comes off and Lula becomes the next Nicolas Maduro? For the sake of Brazil, I pray that is not the case.

@monicabergamo’s reporting raises a fundamental question. Did Zanin order a nationwide extension of voting without even establishing whether it could actually be implemented? If extending voting required individual intervention at hundreds of thousands of machines (490k), officials must disclose exactly what instructions were issued, what changes were made and where. “Reprogramming would be necessary” warrants a precise, documented explanation of what happened.

Oh the gig is up. Next play in the playbook? @LulaOficial’s PT is sending a congresswoman to demand that @FlavioBolsonaro’s Brazilian passport be confiscated so he cannot leave Brazil even though he’s challenging the election results.

She says that the next steps of “that criminal” is to try to flee Brazil. She continues, “we cannot allow him to join his brother in the United States.”

Relax, lady. It’s not going to be so simple. Election is not over. Save the lawfare for after there’s an examination of what happened during the Zanin window.

Wow @monicabergamo reposts a critical fact that helps make sense of the Zanin Window. Sources inside the TSE (electoral court) are explaining that extending the voting by 2 hours required REPROGRAMMING 490,000 voting stations, one by one.

How did they think they would get away with this? These guys are out of control.
