After partisan decisions like Shelby County and Dobbs, we knew that policies to bridge inequalities like affirmative action were in jeopardy at the Supreme Court. But that does not make today’s ruling any less disgraceful.

For decades we’ve seen institutions of higher education use affirmative action as a step to bringing about equal opportunity. The court knows this too – they’ve deemed it not just permissible, but necessary for military academies to continue using race as a factor in admissions.

As I grapple with this ruling, I'm inspired and motivated by @MichelleObama's words: "we've got to do the work not just to enact policies that reflect our values of equity and fairness, but to truly make those values real in all of our schools, workplaces, and neighborhoods."

I continue to be troubled by the radical agenda of the conservative justices as they continue to upend of decades of precedent. As Justice Sotomayor wrote: “the Court's opinion is not grounded in law or fact and contravenes the vision of equality embodied in the Fourteenth Amendment”

Going forward we must double down on actions and policies to create a more fair and just society. Colleges must ensure that students of color are not deterred from applying, and have a moral obligation to employ other admissions criteria that may enhance diversity. It helps to lift everyone.

As Justice Ketanji Brown-Jackson said in her dissent: “deeming race irrelevant in law does not make it so in life.”
