Am Abend des 18. August 2026 ging bei der Verteidigung von Dr. Reiner Füllmich der Beschluss des Bundesgerichtshofs ein, mit dem seine Revision gegen das Urteil des Landgerichts Göttingen verworfen wurde.

Das Landgericht Göttingen hatte Füllmich am 24. April 2025 zu einer Freiheitsstrafe von drei Jahren und neun Monaten verurteilt. Zugleich hatte es angeordnet, dass fünf Monate der Untersuchungshaft nicht auf die verhängte Freiheitsstrafe angerechnet werden. Die Revision war seit mehr als einem Jahr anhängig.

Inhaltlich bestätigt und begründet der #BGH insbesondere die bereits vom Landgericht angeordnete Nichtanrechnung dieser fünf Monate. Er stützt sie erneut auf das von ihm als unflätig bewertete Verhalten Füllmichs während des Strafverfahrens und der Untersuchungshaft.

Besonders brisant ist das Datum des BGH-Beschlusses: Er trägt den 17. März 2026, ging der Verteidigung jedoch erst am Abend des 18. August 2026 zu. Zunächst war nicht auszuschließen, dass es sich dabei um einen Schreibfehler handeln und tatsächlich der 17. August gemeint sein könnte. Nach dem derzeitigen Erkenntnisstand sprechen jedoch mehrere Anhaltspunkte dafür, dass der Beschluss tatsächlich bereits am 17. März gefasst und erst rund fünf Monate später übermittelt wurde. Gerade bei einer Untersuchungshaft greift das Beschleunigungsprinzip des Strafverfahrensrechts, wonach ein Verfahren so rasch wie möglich durchgeführt werden muss.

Die genauen Umstände sind noch nicht abschließend geklärt. Rechtsanwältin Katja Wörmer, Verteidigerin von Dr. Reiner Füllmich, hat deshalb einen Antrag auf Berichtigung beziehungsweise Aufklärung dieser erheblichen zeitlichen Diskrepanz gestellt.
