Let’s look at Nnamdi Kanu issue with legal clarity rather than sentiments.

First, on the claim that the Supreme Court ordered that the charges be amended; that’s not accurate. The apex court never made any such order.

What the Supreme Court did was remit the matter back to the Federal High Court for trial, after affirming that the court had jurisdiction to hear the case.

If the Supreme Court had found the charges defective or the trial unlawful, it would have struck out the case entirely.

Instead, it held that whatever procedural irregularities that occurred during Kanu’s rendition did not rob the court of jurisdiction to try him. That judgment effectively revalidated the trial process, not nullified it.

Second, the argument that Kanu’s trial is based on a repealed law is also misplaced.

The Terrorism Prevention (Amendment) Act 2013 was replaced by the Terrorism (Prevention and Prohibition) Act 2022, but the latter law includes a saving clause.

Section 70 of the 2022 Act expressly states that any charge, investigation, or prosecution commenced under the previous law remains valid as though instituted under the new one.

This means the ongoing case did not suddenly become invalid simply because a new statute was enacted. Courts apply the corresponding provisions of the new law where necessary.

Third, on the issue of jurisdiction, it’s important to note that this has been settled long ago.

The question of whether the Federal High Court has jurisdiction was raised before Justice Binta Nyako, taken to the Court of Appeal, and finally to the Supreme Court; and each of these courts affirmed that the Federal High Court retains jurisdiction to try Kanu.

In law, once the Supreme Court decides an issue, it becomes res judicata; meaning it is final and cannot be reopened or argued again in the same case.

Finally, the court gave Kanu multiple opportunities to open his defence, in full compliance with Section 36 of the Constitution on fair hearing. He refused, insisting on rearguing issues that had already been conclusively settled.

The judge had no choice but to foreclose his defence and move the case to judgment. Justice must run its full course; not just for the defendant, but also for the many victims of the violence linked to the activities under trial.

In summary, the Supreme Court did not order any amendment of charges, the law under which he is being tried is still valid, and the issue of jurisdiction has been conclusively settled.

What remains now is for the court to deliver judgment based on the facts and evidence properly before it.
